Terms of Service

1. Agreement to Terms

By accessing or using MediTours ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform.

2. What MediTours Does (and Does Not Do)

MediTours is a booking platform only. We facilitate connections between patients and independent licensed medical providers in Mexico. We are not:

• A medical provider, clinic, or hospital
• A healthcare insurer or benefits administrator
• Responsible for the quality, safety, or outcome of any medical treatment
• An agent or employer of any doctor listed on the Platform

All medical professionals on MediTours are independent contractors who have verified their credentials with us. However, we make no warranty about the quality of care you will receive.

3. Deposits and Payments

When you pay a deposit through MediTours:

• Deposits are held in escrow via Stripe and are not released to the doctor until the consultation is marked complete
• The deposit amount is typically 20% of the procedure price, capped at $300 USD
• MediTours retains 12.5% of the procedure amount as a platform fee
• Refund policies are set by each individual doctor and disclosed before booking

4. Medical Tourism Risks

Medical tourism carries inherent risks including but not limited to:

• Complications from travel before or after procedures
• Differences in medical standards, practices, and regulatory oversight between countries
• Limited legal recourse in foreign jurisdictions
• Language barriers that may affect communication with medical staff
• Limited follow-up care upon returning to your home country

We strongly recommend consulting your primary care physician before pursuing treatment abroad.

5. User Responsibilities

• You must be at least 18 years old to use the Platform
• You must provide accurate and complete information in all consultation requests
• You are responsible for your travel arrangements, accommodations, and insurance
• You must not use the Platform for any unlawful purpose

6. Doctor Responsibilities

Doctors listed on MediTours agree to maintain valid medical licenses, carry appropriate malpractice insurance, and respond to consultation requests within 48 hours. MediTours reserves the right to remove any doctor from the Platform at any time.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEDITOURS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, MEDICAL COMPLICATIONS, OR LOSS OF PROFITS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claims arising from use of the Platform shall not exceed the amount you paid to MediTours (i.e., our 12.5% platform fee) in the six months preceding the claim.

8. Dispute Resolution

Any disputes between you and a medical provider must be resolved directly with that provider. For disputes with MediTours specifically, please contact us at legal@meditours.com.mx. We will make reasonable efforts to mediate disputes informally before any formal proceedings.

9. Governing Law

These Terms are governed by the laws of Baja California, México. You consent to jurisdiction in Tijuana, Baja California for any disputes with MediTours.

10. Changes to Terms

We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the new Terms. We will notify registered users of material changes by email.
